17 Years of Age

• If one applicant is between the ages of 17 and 18, the other applicant cannot be more than four years (48 months) older. No exceptions.

• The minor's parents/legal guardian, next of kin, other person having custody of the applicant, or duly authorized representative of a public or private agency having legal custody of the applicant shall join in the application either by personal appearance before the county clerk, or by submitting a sworn and notarized Affidavit for Underage Marriage Consent. *This is not required if the 17 year old applicant is emancipated; however, certified proof of emancipation must be presented at time of application.

• Blood tests are no longer needed

• An underage application is required. Provisions allowing judges to waive the age restrictions have been repealed. Underage marriages can no longer be authorized by court order.

• Identification requirements
     Certified birth certificate
  Accompanying parents must have one of the following:
     Driver License
     State issued ID
     Certified Birth Certificate
     Military ID
     Passport
  

• COST:
  There are two price options:

  1) With Certification of Completion certifying at least four hours of premarital counseling - $40 (includes $5.00 fee for certified copy of marriage certificate). An additional $2.25 notary fee may be incurred for each Affidavit for Underage Marriage Consent.

  2) Without Certification of Completion certifying at least four hours of premarital counseling - $102.50 (includes $5.00 fee for certified copy of marriage certificate). An additional $2.25 notary fee may be incurred fo each Affidavit for Underage Marriage Consent.
  

• You must know the following:
     Parents full name (including maiden name of mother)
     Parents state of birth and address (if living)
     Applicant's number of prior marriages
     Date last marriage ended (if applicable)

• A marriage license is valid for 30 days after issuance and may be executed outside of Tennessee. However, it must be returned to the issuing County Clerk for recording and filing with the Tennessee Vital Records Office.

• Checks accepted from Hamilton County residents only. VISA, MasterCard or Discover accepted.
